TERMS OF SALE
When purchasing product from Fontile Kitchen & Bath you must be prepared to adhere to the terms and conditions listed below.
While we do everything possible to meet delivery requirements, orders can only be accepted subject to delays caused by strikes, accidents, supplier deliveries, and/or any other conditions beyond our control.
Fontile Kitchen & Bath reserves the right to hold and/or cancel credit privileges and orders in the event a customer becomes delinquent in their payments, or when they exceed their credit limit.
Prices, terms and conditions are those in effect at time of shipment and are subject to change without notice.
This agreement shall be governed by the laws of the province in which the branch of Fontile Kitchen & Bath, which sold the product, is situated. Point of sale will be at Fontile Kitchen & Bath branch location from where the product was shipped.
Shading and variation is inherent in ceramics and natural stone. Please inspect before installing, no claims accepted after installation. Returns accepted within 30 days of date of purchase. A minimum 20% restocking charge will be made on all accepted returns. Returned product must be prepaid and in original cartons, in saleable condition and accompanied by original invoice number. No returns accepted for discontinued, clearance, sale-priced or liquid/powder products.
All sizing is actual. Shade variation is inherent in ceramics and natural stone. Please inspect before installing, no claims accepted after installation. If, for any reason, our products are regarded as unsatisfactory, we must be notified before installation, and consequently we will not make any allowances for labour costs for replacing material, or for other charges. Methods of installation are beyond our control, and we do not accept responsibility for chipping, cracking, crazing, spalling, etching, discolouration or loosening of tile from the setting bed, caused during the installation process.
Delivery to carrier shall constitute delivery to customer regardless of the carrier used, whether freight is prepaid or collect. Fontile recommends that all Freight Deliveries be fully inspected at time of receipt and any shortages or damages be clearly marked on the delivery receipt when signing for the delivery. Claims for merchandise lost, damaged, or delayed in transit must be made against the carrier by the customer. All claims for shortages must be reported within five (5) days after receipt of shipment to the carrier.
These terms and conditions constitute the sole and entire agreement between Fontile Kitchen & Bath and the customer, and Fontile Kitchen & Bath shall not be bound by any other conditions, oral or written, expressed or implied, other than those contained herein.
